.239 Conference (Expedited Administrative Conference)

The fast administrative conference under Minn. Stat. § 176.239 that decides whether an insurer may discontinue benefits after filing a NOID.

The ".239 conference" (named for Minn. Stat. § 176.239) is the quick, informal proceeding that follows a NOID. When the insurer files its notice to stop your checks, you can request this expedited conference, and doing so promptly (within roughly 12 days of the notice) is what can keep benefits being paid until the conference decides the issue.

The conference itself is short and often held remotely. Each side presents its basis: the insurer’s IME report or return-to-work evidence against your treating doctor’s restrictions, your work status, and your cooperation with rehab. A decision issues quickly (typically within days), either allowing the discontinuance or ordering benefits to continue.

Because it moves so fast, the .239 conference is won with preparation, not oratory: current written restrictions, a clean timeline, wage records, and proof of job search or cooperation. Either side dissatisfied with the result can still pursue a formal hearing, but the conference sets the status quo, and whoever has benefits flowing during the longer fight has the leverage.
